What Is the TCPA?
The Telephone Consumer Protection Act (TCPA) is a federal law that prohibits companies, debt collectors, and telemarketers from calling or texting your cell phone using an automatic telephone dialing system (ATDS) or a pre-recorded message without your prior express written consent. It also restricts calls to numbers on the National Do Not Call Registry.
What Counts as a TCPA Violation?
Common TCPA violations include:
- Robocalls or auto-dialed calls to your cell phone without consent
- Pre-recorded or artificial voice messages without consent
- Spam texts or automated text messages from short codes or unknown numbers
- Calls or texts that continue after you have told the caller to stop
- Calls to your number on the Do Not Call Registry
- Robo-voicemails dropped without your phone ringing (also called "ringless voicemails")
What Can You Recover Under the TCPA?
The TCPA provides for statutory damages of $500 per violation for negligent violations, and up to $1,500 per violation for knowing or willful violations — for every individual call or text.
